Baileys Off Trade Full Terms and Conditions (the "Promotion")

1. The Promotion is open to all residents of Great Britain aged 18 or over.

2. Employees of the Promoter and its affiliate companies, their families and anyone deemed to be professionally involved with or connected to the Promotion are not permitted to enter the Promotion. 

3. Mobile phone and internet access required for entry. No purchase necessary. 

4. To enter the Promotion, see the promotional POS in any participating Sainsbury’s store, then text BAILEYS followed by a space and your date of birth (DD/MM/YYYY) to 66222 between 00:00 on 03/04/2024 and 23:59 on 24/05/2024. Entries received outside of this time will be void and will not be entered into the Promotion. Only one entry per mobile number per week and a maximum of 4 entries per mobile number in total. Valid entrants will receive a thank you message confirming their entry into the prize draw for the chance to win a pair of tickets to the Grand Final of the Eurovision Song Contest 2025. 

5. Entrants are advised to take care when entering the text keyword and their date of birth details. The Promoter is not responsible for typographical errors and incorrect texts may still be charged. Only correct entries that have followed the instructions and the correct order, i.e., ‘BAILEYS’, and date of birth (DD/MM/YYYY) will be accepted. Capital letters or lowercase letters will both be accepted. Text entries will be charged at your standard network rate and may not be included in any inclusive text message package.  

6. There will be 1 winner in total. The prize includes a pair of tickets to the Grand Final of the Eurovision Song Contest 2025. The destination of the Grand Final of the Eurovision Song Contest 2025 will be known once the winner of the Eurovision Song Contest 2024 has been announced on 11th May 2024. Should the destination be in a country outside of the European continent or in a sanctioned country as may be identified from time to time or within a nation or territory that has travel warnings or restrictions from the UK Foreign Office in place, the Promoter will offer a cash alternative of £450 in lieu of the pair of Grand Final tickets to the Eurovision Song Contest 2025 tickets. 

7. The winner and their guest must be over 18. 

8. Should the Grand Final destination be suitable, and the tickets awarded then the winner will need to make sure that they are available to travel on the dates confirmed by the Promoter. The dates of travel will not be flexible. The winner and their guest must be able to attend on the date disclosed by the Promoter once the destination has been confirmed. The Promoter will have no liability or responsibility if the winner or their guest cannot attend on the dates or to the location of the Grand Final of the Eurovision Song Contest 2025.

9. The prize includes £1,000 travel allowance to include meals and accommodation. The winner will be responsible for booking their own travel and accommodation. All other expenses are excluded. Full details of the prize will be supplied to the winner following the winner notification. 

10. The winner and their companion are each responsible for ensuring that they each have a valid passport, are eligible for any applicable visa waiver programme or are in possession of a valid visa, as appropriate, and for ensuring that they have all necessary travel and medical insurance (prior to travelling and at all times during the period of travel) and any vaccinations as required. 

11. To the maximum extent permitted by law, the Promoter shall not be liable for any loss and/or personal injury suffered by or to the winner and/or any of their companions that occurs as a result of the winner’s and/or their companions’ participation in the prize. The winner shall be responsible for any damage to venue (including their contents) visited by the winner and any companions throughout the trip caused by their deliberate or negligent act or omission. The taking of the prize subject to the winner agreeing to the contractual terms of the travel provider and also any specific terms which relate to the Eurovision Song Contest tickets.

12. The winner will be the first valid entry electronically drawn at random from all entries correctly submitted in accordance with these terms and conditions on 31st May 2024. An appropriate amount of reserve winners will be selected at the same time.

13. The winner of the Prize will be notified within Five (5) working days of the prize draw, via a telephone call to the mobile number used to enter the promotion and will be asked to confirm their email address for their ticket delivery and their bank details for their travel allowance.

14. If a winner does not respond to the notification within Seven (7) days, an alternative winner may be contacted by the same process as set out above.

15. The Eurovision Song Contest tickets will be in the form of digital tickets which will be delivered via email to the email address provided upon prize claim at least 1 week before the event. The Promoter will not be liable for non-delivery of a prize caused by the provision of wrong information or other causes beyond the Promoter’s control.

16. The winners will receive their travel allowance within 28 days of a valid prize claim. 

17. The prize is non-transferable. The Provider reserves the right to substitute the prize with a prize of equal or greater value. 

18. The Promoter will use your personal information only in accordance with these terms and conditions and our privacy policy which can be found at the following link: https://footer.diageohorizon.com/dfs/assets/www.diageo.com/PrivacyPolicy_en.html?locale=en-gb. The Promoter will only use your personal information for the purpose of carrying out the Promotion. Where the Promoter is not responsible for the fulfilment of or delivery of the prize, the Promoter shall share your personal information with Umbrella Risk Management Ltd who is responsible for the fulfilment of and delivery of the prize.

19. Subject to paragraph 20 and without prejudice to the Promoter's data protection obligations under relevant law, the Promoter shall make available, upon receipt of a written request (which includes a stamped addressed envelope for such a response) 8166 Baileys Eurovision T2W, PO Box 906, Chilton, Aylesbury, HP22 9HR; the winners’ surname and county.

20. Entrants to the Promotion can, at any time (including at or before the time of entry), object to all or some of their personal information being made available in accordance with paragraph 19 by emailing consumercare.GBandIreland@diageo.com. However, the Promoter shall provide the information set out in paragraph 19 upon request from such competent authorities (including without limitation the Advertising Standards Authority).

21. The winner may be asked to take part in publicity.

22. The Promoter reserves the right to withdraw, amend or terminate (temporarily or permanently) these terms and conditions or the Promotion with or without prior notice where it becomes necessary to do so due to any unforeseen circumstances outside their reasonable control (including, without limitation, in the case of anticipated, suspected, or actual fraud or in the event of technical or other difficulties that might compromise its integrity). 

23. Entries that contain any offensive or inappropriate content will be deleted and disqualified at the Promoter's discretion. 

24. No correspondence will be entered into concerning the result and the Promoter’s decision in all matters relating to the Promotion is final.

25. The Promoter and their agents accept no responsibility for entries that are not received for any reason or difficulties experienced in submitting an entry to this Promotion and proof of submission will not be accepted as proof of delivery.

26. While nothing in these terms and conditions will limit the Promoter’s liability for death or personal injury caused by its negligence or for fraud, the Promoter will not be legally responsible to entrants or winners for any losses that were not foreseeable to the Promoter or to the entrant at the time of entry to the Promotion or which are caused by a third party.

27. This Promotion and these terms and conditions are governed by English law and subject to the exclusive jurisdiction of the English Courts. 

28. Entrants are deemed to have accepted these terms and conditions by participating in this Promotion.
