Terms & Conditions

1. The Promotion is open to all residents of United Kingdom (excluding Northern Ireland) aged 18 or over.

2. Employees of the Promoter and its affiliate companies, their families and anyone deemed to be professionally involved with or connected to the Promotion are not permitted to enter the Promotion. 

3. Purchase and mobile phone required for entry.

4. To enter the Promotion, purchase any Diageo product within any participating Asda store. Then text SUMMER followed by a space, the last four digits of the product barcode, another space and your date of birth (DD/MM/YYYY) to 66222 between 00:00 on 14th September 2023 and 23:59 on 4th October 2023. Entries received outside of this time will be void and will not be entered into the Promotion. Only one entry per mobile number throughout the promotional period. Valid entrants will receive a thank you message and will be entered into a prize draw to win either 1 x £2,000 cash prize or 1 of 10 x £100 Asda eVouchers. 

5. Entrants are advised to take care when entering the text code and entry details. The Promoter is not responsible for typographical errors and incorrect texts may still be charged. Only correct entries that have followed the instructions and the correct order, i.e. ‘SUMMER’, the last four digits of the barcode and date of birth (DD/MM/YYYY), will be accepted. Capital letters or lowercase letters will both be accepted. Text entries will be charged at your standard network rate and may not be included in any inclusive text message package.  

6. There will be 11 winners in total. The prizes are a 1 x £2,000 cash prize or 10 x £100 Asda eVouchers. Prizes are limited to a maximum of one per person.

7. The winners will be the first valid entries electronically drawn at random from all entries correctly submitted in accordance with these terms and conditions on 11th October 2023. Winners will be notified via the mobile phone number used to enter promotion with on or before 18th October 2023. An appropriate amount of reserve winners will be selected at the same time.

8. The winner of the £2,000 cash prize will be required to confirm their name, email address and date of birth over the phone in order to accept their prize. Every reasonable attempt will be made to contact the winners. If a winner does not respond to the phone call within 7 calendar days of the initial call, a reserve winner will be contacted by the same process as set out above. A maximum of 1 reserve winner will be contacted if the prize remains unclaimed. Winners of the £100 Asda eVouchers will receive their prize by text message to the mobile phone number provided upon claim.

9. 1 winner will receive a £2,000 cash prize which will be awarded by BACS. The remaining 10 winners will receive a £100 Asda eVoucher via a text message to the mobile number provided upon entry. The £2,000 winner will require a valid bank account to claim. eVouchers will be delivered by text within 28 days of a prize claim. Use of the Voucher is subject to the terms and conditions applicable to Asda eVoucher, available at: https://www.asdagiftcards.com/terms-and-conditions. 

10. The prize is non-transferable and there is no cash alternative. The Provider reserves the right to substitute the prize with a prize of equal or greater value. Please allow 28 calendar days for delivery of the prize. Any manufacturer’s references or printing errors on the promotional point of sale communication do not constitute valid promotional keyword or barcode. 

11. The Promoter will use your personal information only in accordance with these terms and conditions and our privacy policy which can be found at the following link: https://footer.diageohorizon.com/dfs/assets/www.diageo.com/PrivacyPolicy_en.html?locale=en-gb. The Promoter will only use your personal information for the purpose of carrying out the Promotion. Where the Promoter is not responsible for the fulfilment of or delivery of the prize, the Promoter shall share your personal information with Umbrella Risk Management Ltd who is responsible for the fulfilment of and delivery of the prize.

12. Subject to paragraph 13 and without prejudice to the Promoter's data protection obligations under relevant law, the Promoter shall make available, upon receipt of a written request (which includes a stamped addressed envelope for such a response) the winners’ surnames.

13. Entrants to the Promotion can, at any time (including at or before the time of entry), object to all or some of their personal information being made available in accordance with paragraph 12 by writing to 7967 FlavourFest Asda, PO Box 906, Chilton, Aylesbury, HP22 9HR. However, the Promoter shall provide the information set out in paragraph 12 upon request from such competent authorities (including the Advertising Standards Authority).

14. The winner may be asked to take part in some reasonable publicity.

15. The Promoter reserves the right to withdraw, amend or terminate (temporarily or permanently) these terms and conditions or the Promotion with or without prior notice where it becomes necessary to do so due to any unforeseen circumstances outside their reasonable control (including, without limitation, in the case of anticipated, suspected or actual fraud or in the event of technical or other difficulties that might compromise its integrity). 

16. Entries that contain any offensive or inappropriate content will be deleted and disqualified at the Promoter's discretion. 

17. No correspondence will be entered into concerning the result and the Promoter’s decision in all matters relating to the Promotion is final.

18. The Promoter and their agents accept no responsibility for entries that are not received for any reason or difficulties experienced in submitting an entry to this Promotion and proof of submission will not be accepted as proof of delivery.

19. While nothing in these terms and conditions will limit the Promoter’s liability for death or personal injury caused by its negligence or for fraud, the Promoter will not be legally responsible to entrants or winners for any losses that were not foreseeable to the Promoter or to the entrant at the time of entry to the Promotion or which are caused by a third party.

20. This Promotion and these terms and conditions are governed by English law and subject to the exclusive jurisdiction of the English Courts. 

21. Entrants are deemed to have accepted these terms and conditions by participating in this Promotion.
