Guinness Glasses Social Promotion Terms and Conditions (the "Promotion")
1. The Promotion is open to all residents of Great Britain aged 25 or over.
2. Employees of the Promoter and its affiliate companies, their families and anyone deemed to be professionally involved with or connected to the Promotion are not permitted to enter the Promotion.
3. No purchase necessary. Internet access and an Instagram or Facebook account are required to enter.
4. To enter the Promotion via Instagram or Facebook, follow @Guinnessgb, then like and comment on our post on either Instagram or Facebook between 00:00 on 15th April 2024 and 23:59 on 22nd April 2024 for your chance to win 1 of 10 pairs of Guinness glasses. Entries received outside of these dates will be void and will not be entered into the Promotion.
5. Entrants are asked to refrain from sharing these promotional entry details with anyone under the legal purchasing age of 18 years old.
6. Maximum of 1 entry per Instagram or Facebook account and maximum of 1 prize per household.
7. There will be 1 prize draw in total. There will be 10 pairs of Guinness glasses available to be won. Each winner will receive 2 Guinness glasses, 1 for them and 1 for a friend.
8. The winners will be drawn within 48 hours of the close of the promotion by an independent third party from all entries correctly submitted in accordance with these terms and conditions and notified via direct message within 48 hours of the close date of the draw. An appropriate number of reserves will be drawn at the same time as the winners. If you are a winner, Born Social may tag you in order to request the direct message function. It is the responsibility of the entrant to ensure their social media accounts are set to ‘Public’ in order to allow relevant details to be extracted for entry into the Promotion. The Promoter is not responsible for any failure to extract details from accounts which haven’t been set up as required.
9. The prizes will be awarded to the authorised account holders of the Instagram or Facebook handle. The authorised account holder is the natural person who is assigned to the social media handle.
10. If a winner does not respond to the notification informing them they have won within 7 days, providing their full name, contact phone number, full delivery address and date of birth, their prize will be forfeited and an alternative winner may be selected by the same process as set out above.
11. The prize is non-transferable and there is no cash alternative. The Promoter reserves the right to substitute a prize with a prize of equal or greater value.
12. Prize Delivery: The winners will receive their prize by post within 40 days of the date of their prize claim. Prizes will only be delivered to a registered address in Great Britain. Delivery of the prize may be subject to delays due to Royal Mail strikes or other causes. The Promoter takes no responsibility for any prize which is lost in transit or unable to be delivered for any reason.
13. Whilst the Promoter will take all reasonable steps to ensure that its obligations under this clause relating to meeting specific timeframes for Prize notification and Prize fulfilment, the Promoter shall not be liable in any way for its inability to meet these timeframes resulting from an outbreak of Covid-19 either within its own business or within the Prize delivery supply chain. Should Covid-19 affect the Promoter’s ability to meet these deadlines, it will fulfil its obligations under this clause as soon as is reasonably possible after its and/or its third-party fulfilment providers resume business as usual.
14. The Promotion and the Promoter's Instagram and Facebook pages are not sponsored, endorsed or administered by, or associated with Instagram or Facebook. By entering into the Promotion, entrants release Instagram and/or Facebook from all and any claims and liabilities which might arise in relation to the Promotion. You understand that you are providing your information to the Promoter and not to Instagram and/or Facebook.
15. The Promoter will use your personal information only in accordance with these terms and conditions and its privacy policy which can be found at https://footer.diageohorizon.com/dfs/assets/www.diageo.com/PrivacyPolicy_en.html?locale=en-gb. The Promoter will only use your personal information for the purpose of carrying out the Promotion. Where the Promoter is not responsible for the fulfilment of or delivery of the prize, the Promoter shall share your personal information with Born Social who is responsible for the fulfilment of and delivery of the prize.
16. Subject to paragraph 17 and without prejudice to the Promoter's data protection obligations under relevant law, the Promoter shall make available, upon receipt of a written request (which includes a correctly stamped self addressed envelope for such a response) to Guinness Glasses Social Giveaway, 20 Curtain Road, London, EC2A 3NG, the winner’s surnames and counties for a period of 3 months after the close date of the Promotion.
17. Entrants to the Promotion can, at any time (including at or before the time of entry), object to all or some of their personal information being made available in accordance with paragraph 16 by emailing to consumercare.GBandIreland@diageo.com. However, the Promoter shall provide the information set out in paragraph 16 upon request from such competent authorities (including without limitation the Advertising Standards Authority).
18. The Promoter reserves the right to disqualify entries made using multiple Instagram or Facebook accounts.
19. The Promoter reserves the right to withdraw, amend or terminate (temporarily or permanently) these terms and conditions or the Promotion with or without prior notice where it becomes necessary to do so due to any unforeseen circumstances outside its reasonable control (including, without limitation, in the case of anticipated, suspected or actual fraud or in the event of technical or other difficulties that might compromise its integrity).
20. No correspondence will be entered into concerning the result and the Promoter’s decision in all matters relating to the Promotion is final.
21. The Promoter and its agents accept no responsibility for entries that are not received for any reason or difficulties experienced in submitting an entry to this Promotion and proof of submission will not be accepted as proof of delivery.
22. The Promoter is not responsible for computer or network problems, problems with servers, other programming, electronic or technological failures/errors/malfunctions of any kind (including but not limited to filtering by or operation of the functionality of Twitter) or the failure to receive any posts or inability to contact the potential prize winner for any reason whatsoever.
23. While nothing in these terms and conditions will limit the Promoter’s liability for death or personal injury caused by its negligence or for fraud, the Promoter will not be legally responsible to entrants or winners for any losses that were not foreseeable to the Promoter or to the entrant at the time of entry to the Promotion or which are caused by a third party.
24. This Promotion and these terms and conditions are governed by English law and subject to the non-exclusive jurisdiction of the English Courts.
25. Entrants are deemed to have accepted these terms and conditions by participating in this Promotion.
