Guinness Nitrosurge Giveaway Promotion Terms and Conditions (the "Promotion")

The Promotion is open to all residents of Great Britain aged 18 or over.
Employees of the Promoter and its affiliate companies, their families and anyone deemed to be professionally involved with or connected to the Promotion are not permitted to enter the Promotion.
No purchase necessary. Internet access and an Instagram account are required to enter.
To enter the Promotion via Instagram, follow @guinnessgb, like the Nitrosurge post and tag a friend you would like to give the 2nd pair of Nitrosurge bundle to between 00:00 07/10/23 - 23:59 31/10/23 for your chance to win 1 of 10 pairs of Nitrosurge bundles. Bundle includes: 2x Guinness Nitrosurge devices and x2 4 cans of Guinness. Entries received outside of these dates will be void and will not be entered into the Promotion.
Entrants are asked to refrain from sharing these promotional entry details with anyone under the legal purchasing age of 18 years old.
Maximum of 1 entry per Instagram account and maximum of 1 prize per household.
There will be 1 prize draws in total. There will be 10 (ten) prizes available to be won. Each prize includes a pair of Nitrosurge bundle. Bundle includes: 2x Guinness Nitrosurge devices and x2 4 cans of Guinness.

Entry Content Restrictions: Entries into the Promotion will be rejected/deleted and will not be deemed valid entries for the purposes of this Promotion if in the opinion of the Promoter, they:
contain any comment that is offensive, inappropriate, indecent or could reflect negatively on the name, reputation, or goodwill of the Promoter, its products, its brands or any brand partner of the Promoter;
defame, misrepresent, or insult other people or companies, including, but not limited to the Promoter (including its partners);
promote any political agenda;
violate or infringe another’s rights, including without limitation, privacy or intellectual property rights (including but not limited to copyright infringement);
contain comments that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
condone or encourage violent or anti-social behaviour;
reference persons or organisations without their written permission;
disparage any persons or organisations;
include threats to any person, place, business or group;
are unlawful, in violation of or contrary to any applicable laws and/or regulations;
are contrary to or in violation of any provision of these terms and conditions;
represent a danger to health and safety or causes fear or distress; or
are otherwise offensive or in bad taste.
The winners will be selected via a prize draw on 01/11/2023 which will be performed by a computer program which produces verifiably random results from all entries correctly submitted in accordance with these terms and conditions and notified via direct message within 48 hours of the close date of the draw. An appropriate number of reserves will be drawn at the same time as the winners. There will be 10 winners. If you are a winner via Instagram, you will be notified by direct message on Instagram from the @GuinnessGB account, moderated by Born Social, as appointed by the Promoter. If Born Social does not have access to direct message you on Instagram as a winner they may comment on your post to request this. It is the responsibility of the entrant to ensure their social media accounts are set to ‘Public’ in order to allow relevant details to be extracted for entry into the Promotion. The Promoter is not responsible for any failure to extract details from accounts which haven’t been set up as required.
The Promoter reserves the right to disqualify any entry submitted to the Competition that they suspect may breach any third party intellectual property rights.
The prizes will be awarded to the authorised account holders of the Instagram handles. The authorised account holder is the natural person who is assigned to the social media handle.
If a winner does not respond to the notification informing them they have won within 3 days, providing their full name, contact phone number, full delivery address and date of birth, their prize will be forfeited and an alternative winner may be contacted from the list of reserves..
The prize is non-transferable and there is no cash alternative. The Promoter reserves the right to substitute a prize with a prize of equal or greater value.
Prize Delivery: The winners of a pair of Nitrosurge bundles will be sent their bundles via the Promoter’s appointed fulfilment house. Bundle includes: 2x Guinness Nitrosurge devices and x2 4 cans of Guinness. Your Guinness Nitrosurge bundle will be delivered by courier within 28 days of winning claim.
Failure of any entry to comply with the above “Entry Content Restrictions,” as determined by the Promoter in its sole discretion, may result in deletion and disqualification of the relevant entry without notice. Without limitation, the Promoter reserves the right in its sole discretion to delete and disqualify any entry that, in its sole opinion, refers, depicts or in any way reflects negatively upon the Promoter, the Promotion or any other person or entity, does not comply with these terms and conditions or the spirit of the Promotion, or if the Promoter receives notification about any potential infringements or breaches of law or for any other reason set out in these terms and conditions. Entries must be suitable for presentation in a public forum, in the sole determination of the Promoter.
The Promotion and the Promoter's Instagram page is not sponsored, endorsed or administered by, or associated with Instagram. By entering into the Promotion, entrants release Instagram from all and any claims and liabilities which might arise in relation to the Promotion. You understand that you are providing your information to the Promoter and not to Instagram.
The Promoter will use your personal information only in accordance with these terms and conditions and its privacy policy which can be found at https://footer.diageohorizon.com/dfs/assets/www.diageo.com/PrivacyPolicy_en.html?locale=en-gb. The Promoter will only use your personal information for the purpose of carrying out the Promotion. Where the Promoter is not responsible for the fulfilment of or delivery of the prize, the Promoter shall share your personal information with Borns Social who is responsible for the fulfilment of and delivery of the prize.
Subject to paragraph 21 and without prejudice to the Promoter's data protection obligations under relevant law, the Promoter shall make available, upon receipt of a written request (which includes a correctly stamped self addressed envelope for such a response) to Guinness Nitrosurge Social Promotion 1, 20 Curtain Road, London, EC2A 3NG, the winner’s surnames and counties for a period of 3 months after the close date of the Promotion.
Entrants to the Promotion can, at any time (including at or before the time of entry), object to all or some of their personal information being made available in accordance with paragraph 20 by emailing to consumercare.GBandIreland@diageo.com. However, the Promoter shall provide the information set out in paragraph 20 upon request from such competent authorities (including without limitation the Advertising Standards Authority).
The Promoter reserves the right to disqualify entries made using multiple Instagram accounts.
The Promoter reserves the right to withdraw, amend or terminate (temporarily or permanently) these terms and conditions or the Promotion with or without prior notice where it becomes necessary to do so due to any unforeseen circumstances outside its reasonable control (including, without limitation, in the case of anticipated, suspected or actual fraud or in the event of technical or other difficulties that might compromise its integrity).
No correspondence will be entered into concerning the result and the Promoter’s decision in all matters relating to the Promotion is final.
The Promoter and its agents accept no responsibility for entries that are not received for any reason or difficulties experienced in submitting an entry to this Promotion and proof of submission will not be accepted as proof of delivery.
The Promoter is not responsible for computer or network problems, problems with servers, other programming, electronic or technological failures/errors/malfunctions of any kind (including but not limited to filtering by or operation of the functionality of Instagram) or the failure to receive any posts or inability to contact the potential prize winner for any reason whatsoever.
While nothing in these terms and conditions will limit the Promoter’s liability for death or personal injury caused by its negligence or for fraud, the Promoter will not be legally responsible to entrants or winners for any losses that were not foreseeable to the Promoter or to the entrant at the time of entry to the Promotion or which are caused by a third party.
This Promotion and these terms and conditions are governed by English law and subject to the non-exclusive jurisdiction of the English Courts.
Entrants are deemed to have accepted these terms and conditions by participating in this Promotion.
